International Mock Arbitration and Mediation Seminar

As a part of the effort to promote international arbitration in Japan, the Ministry of Justice of Japan co-hosted an “International Mock Arbitration and Mediation” seminar on 25 May 2018, with Orrick Herrington & Suttcliff Tokyo and the Chartered Institute of Arbitrators (CIArb) Japan Chapter.

Approximately 250 participants, including representatives from private companies and legal professionals, attended the seminar.

This seminar provided mock international arbitration and mediation by leading international arbitrators using cross-border disputes over license agreements as a case study to demonstrate how international arbitration and mediation can provide swift and effective resolution. The proceedings were guided and explained by Mr. TAKATORI Yoshihiro, a Fellow of Ciarb (FCIArb) and the Head of Orrick’s Global Japan Practice Group.


Scene 1 featured a demonstration of the benefits of choosing arbitration/mediation over litigation and strategic discussions between counsels and their clients. Scene 2 featured a demonstration of discussions between the arbitral tribunal and counsels during a preparatory hearing in arbitration.

In Scene 3, a demonstration of settlement negotiations during a mediation hearing was performed as part of the Arb.-Med.-Arb. approach, which incorporates mediation during arbitration proceedings. This was followed by a panel discussion.
